Real Money Gaming in India — The Legal Position

How real-money gaming is regulated state by state in India, what skill-versus-chance means in practice, the tax position, and what to check before you play.

Real-money gaming in India does not have one answer. It has a national framework, a state-by-state overlay that changes, and a tax position that changed significantly in recent years.

This page explains the framework. It is not legal advice, and it is not a substitute for checking your own state's current position. The rules in this area move — laws are passed, struck down in court, and re-enacted — so treat anything you read about it, here included, as a starting point rather than a current answer.

Under the Constitution of India, betting and gambling are a State subject. That means each state legislature makes its own law, and the central Public Gambling Act of 1867 acts as a legacy baseline where a state has not replaced it.

The practical consequence: the same app can be lawful to use in one state and prohibited in another, and neither the app nor a website can tell you which applies to you.

Skill versus chanceSkill versus chance

The distinction that most Indian gaming law turns on is whether a game is predominantly skill or predominantly chance. Games of skill have generally been treated as outside gambling prohibitions; games of chance have not.

Indian courts have held that some games are predominantly skill-based — rummy being the most commonly cited. Games where the outcome is fixed by a deal or a spin, with no decision that changes the odds, sit on the other side of that line.

  • Rummy and Teen Patti involve real decisions — which cards to hold, when to fold, whether to play blind or seen.
  • Andar Bahar, Dragon vs Tiger, 7 Up 7 Down, Baccarat and Car Roulette involve none. Once the deal or spin begins, the result is already determined. We say so plainly on each guide.

We are describing the mechanics, not classifying anything legally. Whether a particular game as implemented by a particular operator falls on one side or the other is a question courts decide, and they have decided it differently in different places.

Several Indian states have moved to restrict or prohibit online real-money gaming, including states that have banned it outright and states whose bans were subsequently challenged in court. Some restrictions have been struck down; some have been re-enacted in amended form. A small number of states instead operate licensing regimes.

We are deliberately not publishing a state-by-state table. Any list we printed would be a snapshot, and an out-of-date snapshot on a question like this is worse than none — someone would rely on it.

What to do instead: search for your own state's current gaming legislation, or ask a lawyer, before playing for money. If real-money gaming is prohibited where you are, the fact that an app is downloadable does not make it lawful for you to use.

Two separate things, often confused:

Tax on your winnings. Winnings from online games are subject to tax deducted at source on net winnings, withheld by the operator at withdrawal. This is why PAN details are required before you can withdraw. The deduction happens whether or not you file a return, and net winnings are computed across the financial year rather than per game.

GST on the operator side. Online real-money gaming has been subject to a substantially increased GST rate applied to deposits rather than to operator revenue. This is charged to the operator, but it is a cost that flows into the economics of every app — bonus generosity and payout structures across the industry shifted after it took effect.
